| 1. BOOKING A HOLIDAY |
|
Bookings between KEYS TO FLORIDA (hereafter called'
the Company' or 'KtoF') and the person making the booking (hereafter called
'the Client') are valid after the booking form has been received and the
full deposit paid to the Company. The party leader must sign the booking
form and by doing so accepts these booking conditions on behalf of all persons
named on the booking form (including those substituted or added by any subsequent
amendments). A contract exists when you have paid a deposit and we send
you a written confirmation of your booking. |

2. PAYMENT OF YOUR HOLIDAY |
|
You are required to pay the deposit indicated on
the booking form for each villa/apartment booked. The balance of the holiday
cost as shown on the invoice must be paid 2 months before departure. (Note
that in order to reduce administration costs it is not our policy to issue
reminders.) If the booking takes place less than 10 weeks before departure
then the balance is due immediately upon receipt of the confirmation. If
the balance is not paid by the due date we reserve the right to cancel your
booking and retain any deposit held. Cancellation charges as specified in
Section 5 may apply. |

3. OUR PRICE GUARANTEE |
We guarantee not to increase the cost of your holiday
once full payment is received. You are invited to make early full payment
if you wish to protect yourself against any cost increases or surcharges.
(Any increases in Government imposed taxes/surcharges are excluded from
such guarantee)
If the holiday is not fully paid, and in the unlikely event of an increase
in cost to us of providing your holiday because of circumstances beyond
our control, then KtoF reserves the right to increase the booking by the
amount of such increase. In such circumstances, notification will be made
to the person who signed the booking form either by letter or amended invoice.
The Client will have the choice as detailed under Section 11.This choice
must however be exercised within 14 days of our posting written notice of
increase to you, otherwise the Company will assume acceptance of the amended
cost and the booking continues. There will be no liability for payment of
compensation under this clause. |

4. IF YOU CHANGE YOUR BOOKING |
|
If you wish to change any details of your booking
after we have sent you a written confirmation we will do our best to help.
Any changes must be made in writing and signed by the party leader. A minimum
amendment fee of ,20 will be charged for every detail of the booking changed
in order to cover administration costs. Bookings may not be assigned or
passengers substituted without payment of the appropriate cancellation or
amendment charges. Alterations cannot normally be made within 6 weeks of
departure date and in such circumstances will be treated as a cancellation
of booking. See Section 5. Note- Insurance premiums are not refundable or
transferable and in the case of a substitution an additional premium would
therefore be payable in respect of each new person included in the booking. |

5. IF YOU CANCEL YOUR HOLIDAY |
Any cancellation by the Client must be notified
in writing directly to the Company, and signed by the party leader Such
communication should be either sent by recorded delivery or faxed directly
to the Company. Cancellation becomes effective from the date it is received
in writing by KtoF. All cancellations are subject to a charge expressed
as a percentage of the overall holiday cost excluding insurance and in accordance
with the following table:

Additionally, where KtoF or our Agents have incurred costs in relation to
special requests of the Client, KtoF are entitled to be indemnified in respect
of such costs. |

6. INSURANCE |
|
Never travel without protecting yourself and your
family with holiday insurance. In your interest we make it a condition of
booking that you have comprehensive insurance cover for all passengers included
on the booking form and that the cover provided is comparable to that offered
by KtoF. Insurance will be automatically applied unless the Client deletes
the box on the booking form and supplies full details of the Client's Insurance
Company and the Policy Number. |

7. ACCOMMODATION RESTRICTIONS |
|
Accommodation is reserved exclusively for the use
of the persons named on the Booking Form and strictly no other persons are
permitted to stay. Subletting, sharing and assignment are prohibited, and
to exceed the licensed number of occupants in a property is illegal under
US regulations and could invalidate your insurance. If you have visitors
who wish to join you during your stay and by the inclusion of such guests
the permitted occupancy level of the accommodation is not exceeded, KtoF
will be happy to assist for a nominal fee, providing notification is made
prior to departure. Certain standards of behaviour are expected from the
various local communities and clients are required to observe them. The
Company reserves the right to terminate without compensation the holiday
tenancy of any Client whose behaviour is reported to us or anyone in authority
as causing annoyance, danger or damage to property or any person. In such
circumstances KtoF will not be responsible for any refunds or costs /expenses
incurred by the Client. |

8.ACCOMMODATION DETAILS |
KtoF endeavour to provide you with sufficient information
in our brochure and accompanying literature to enable you to make the right
decision on your holiday accommodation. Opinions expressed by our staff
in the course of booking do not constitute additional warranties or guarantees
unless confirmed in writing at the time the booking is made.
Accommodation will not generally be available for occupation until 4pm on
the agreed date of arrival, immaterial of the Client's arrival time in the
resort. All accommodation must be vacated by not later than 10 am on the
agreed day of departure. Clients are advised to pre-book an additional night's
accommodation if they intend to stay beyond this time. Care should be exercised
with children at properties with private pools as they do not all have depth
markings or necessarily a shallow end. |
|
9. INVENTORY/SECURITY DEPOSITS |
|
Clients are responsible for any breakages, loss
or damage to any item in the property during the holiday rental period.
A charge to cover the cost of replacement or repair will either be made
locally or on your return to the UK. On all properties KtoF will hold an
inventory deposit. The sum will be indicated on your invoice and is payable
with the holiday balance. This will generally be settled within 21 days
of your return less any deductions for breakages or damage if applicable
during your stay. In some circumstances, particularly if renting properties
in the higher rental bracket or homes with account telephone arrangements,
the local agent may require an additional deposit, normally by way of a
Credit Card imprint. In such circumstances this will be explained to you
on arrival. |

10. DISABLED CLIENTS / SPECIAL NEEDS |
|
Provided that KtoF are given prior knowledge of
disabled or clients with special needs then advice can be given on the suitability
of property. Unfortunately many privately owned properties are not suitable
for severely disabled persons. Clients must be sure that they have made
the correct choice of accommodation before signing the Booking Form. |
|
11. CHANGES BY US |
On rare occasions circumstances beyond our control
make it necessary to alter holiday arrangements. Most are minor alterations,
such as withdrawal of some facility at the accommodation. If it is necessary
to make any change to your accommodation KtoF will always do its best to
provide you with an alternative of an equal or better standard to that booked.
If we have to make a major alteration (Excluding Force Majeure-see Section
13) to your holiday arrangements, such as change of resort or change of
accommodation to an inferior property, you may either:
1.Accept the changed arrangements
2.Transfer the booking to an alternative holiday.
3.Cancel and receive a full refund of all monies paid.
In unforeseen circumstances the local Property Manager may be forced to
make a late change to the address of your rental accommodation prior to
your arrival. In such circumstances they will relocate you to a home of
a similar standard and whenever possible will seek to upgrade your accommodation
without extra charge. |

12. IF YOU SHOULD HAVE A COMPLAINT |
In the unlikely event that you should have a complaint
you must report it immediately to our local management agent of the property
in order that they have the opportunity to resolve the matter on the spot.
If you remain dissatisfied then the party leader should complete the Customer
Services Report, which is included with your check-in documents. This should
then be passed to the Property Management agent for forwarding by Fax to
our UK office as shown on the form. Please retain a copy of the report .We
will endeavour to investigate the problem and hopefully resolve the matter
whilst you are in the resort. Once you arrive home, your party leader should
send the form along with a detailed covering letter, to our Customer Services
Department, as addressed on the form, quoting your booking reference and
departure date, within 21 days of your return from holiday. We cannot accept
liability for any complaints, which have not been reported to our agent
first for local rectification nor if the Client fails to follow the above
procedure, or the complaint is received outside of the 21-day period. We
aim to resolve any complaints as amicably as possible and KtoF will endeavour
to acknowledge complaints immediately and to reply to them within 28 days
of receipt.

13. LOCAL CONSTRUCTION |
|
It should be noted that building construction is
almost unavoidable in certain developing areas of Florida, and particularly
in Kissimmee. We do not receive advance notice of such work and neither
KtoF nor our agents can be held responsible for any inconvenience so caused.
If we are notified of any building work, which may be reasonably considered
to adversely affect your enjoyment, we will notify you as soon as possible
and if possible relocate your home. |

14. FORCE MAJEURE |
|
We will not be under any obligation to pay compensation
where any change to or cancellation of your holiday is caused by 'force
majeure' circumstances (i.e. those outside our control, namely: war or threat
of war; riots; civil strife; industrial dispute; airline grounding;, terrorist
activity; natural or nuclear disasters; fire or adverse weather conditions
and all similar events) In these circumstances you may choose options 1,2
or 3 from Section 11 only. |
|
15. FLIGHTS / CAR HIRE |
|
Where the Client requests KtoF to arrange flights/car
hire or other services beyond the standard provision of accommodation, this
is done so as agents for the carrier/ tour operator and in accordance with
their terms and conditions. Your travel by aircraft is governed by International
agreements or conventions between countries that may exclude or limit the
carriers' liabilities to you. You are advised to request and inspect a copy
of these conditions that apply to your journey from the operating company.

16. LIABILITY LIMITATION |
|
In entering into this contract the Client expressly agrees
that the liability of KtoF and their agents is limited to a sum not exceeding
the monies paid to the Company for the services and accommodation provided. It
is further agreed that the Client shall bear the risk of any consequential loss
arising directly or indirectly from the cancellation of the booking and the Client
shall take adequate insurance against such loss. |

17. LAW |
|
It is agreed by all parties that in any action
arising out of or in connection with this contract, English law will govern
and exclusive jurisdiction is conferred on the English courts. |
|
18. VISAS |
|
Neither KtoF nor their Agents are responsible for
ensuring that the client and other members of their party have the relevant
visas or health certificates for travel. |
|
19. SEVERABILITY |
|
Should any part of our agreement be deemed by rule
of law to be void, the remainder of this agreement will if capable continue
in full force and effect. |
